1. Overview

Kernion respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) and equivalent international copyright frameworks. This policy describes how to report copyright infringement on the Platform and how alleged infringers may file counter-notifications.

As a platform committed to free expression, we carefully evaluate all takedown requests to balance legitimate copyright protection with our users' expressive rights, including fair use and other lawful uses of copyrighted material.

2. Filing a Takedown Notice

If you believe that content on Kernion infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include:

  1. Your physical or electronic signature
  2. Identification of the copyrighted work you claim is infringed
  3. Identification of the material on Kernion that you claim is infringing, with sufficient detail for us to locate it (URL or description)
  4. Your contact information (name, address, telephone number, email)
  5. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf

3. Processing Takedown Notices

Upon receiving a valid DMCA notice, we will:

  1. Review the notice for completeness and validity
  2. Evaluate whether the reported use may constitute fair use or another lawful exception
  3. If the notice is valid and no exception applies, promptly remove or disable access to the identified material
  4. Notify the user who posted the material of the takedown and provide a copy of the notice

Incomplete or clearly frivolous notices will not be acted upon. We reserve the right to reject notices that appear to be filed in bad faith or intended to suppress legitimate expression.

4. Counter-Notification

If your content was removed and you believe the removal was a mistake or misidentification, you may file a counter-notification. Your counter-notice must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and the location where it appeared before removal
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  4. Your name, address, and telephone number
  5. A statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the US, any judicial district in which Kernion may be found), and that you will accept service of process from the person who filed the original notice

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we will restore the removed material.

5. Repeat Infringer Policy

In accordance with the DMCA, Kernion maintains a policy for terminating accounts of repeat infringers in appropriate circumstances. Specifically:

  • Users who receive three valid, uncontested takedown notices within a 12-month period may have their account suspended or terminated
  • A takedown notice that is successfully countered does not count toward the threshold
  • We consider the totality of circumstances, including the nature and intent of the alleged infringement, before taking action

6. Misrepresentation Warning

Under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that content is infringing, or that content was removed by mistake, may be liable for damages, including costs and attorneys' fees. Do not file a takedown notice or counter-notification unless you are certain of your claim.
